Acceptance of Terms and Conditions, Quotation & Project:

At the time of proposal, Tatak Studio Pty Ltd can provide the client with a written estimate or quotation by email. If the client chooses to accept the proposal, an Engagement Letter will be sent through to the client for signature. The placement of an order for design and/or any other services offered by Tatak Studio Pty Ltd, by email, verbally or in writing, is deemed to be acceptance of the Engagement Letter, these terms and conditions, which are freely available at www.tatak.com.au/terms-conditions. The client's signature on the Engagement Letter constitutes acceptance of the estimate or quotation and agreement to comply fully with all the Terms and Conditions, forming a Contract for Business between the signatory and Tatak Studio Pty Ltd.

Design Charges:

Once the client has accepted Tatak Studio Pty Ltd's proposal, an Engagement Letter outlining the charges for the design services to be provided will be sent to the client. This Engagement Letter will specify the fees for the project, and 100% of the quoted fee will become due upon completion of the work prior to the release of materials. For projects exceeding $5,000, an advance payment of thirty (30) percent of the project quotation total will be required prior to the commencement of the work with the balance invoiced in monthly instalments as the work is completed. Charges for any additional services requested during the project that are over and above the estimated time or out of scope, will become fully payable (100% of the quoted amount) at the time of estimate or quotation acceptance.

Revisions/Alterations:

The client agrees that changes required over and above the estimated work, or in addition to the agreed scope, or where the client makes changes to the supplied copy or changes required to be carried out after acceptance of the draft design, will be liable to a separate hourly charge stated in the initial proposal/quote. The client also agrees that Tatak Studio Pty Ltd holds no responsibility for any amendments made by any third party, before or after a design is published.

Copyright and Ownership:

At Tatak Studio Pty Ltd, we take pride in the creative work we produce. All design work, including words, pictures, ideas, visuals, and illustrations, is the property of Tatak Studio Pty Ltd, unless otherwise specified in writing and after all costs have been settled. However, we respect your rights as a client, and any materials provided by you, including text, images, or data, remain your ownership or rightful copyright or trademark owner.

Inclusivity and Copyright Permissions:

We uphold inclusivity and respect for intellectual property rights. By providing text, images, or other data to Tatak Studio Pty Ltd for inclusion in your project, you declare that you hold the appropriate copyright and/or trademark permissions. We ensure that any materials you provide will be used with your permission and will not infringe upon any third-party copyrights.

No Hidden Charges for Source Files:

Unlike traditional practices, we are committed to empowering our clients by not charging extra for access to source files. When you engage our design services, the charges cover not only the creation of exceptional designs but also include full access to the copyright design source files, such as .indd, .psd, .ai, .png, and other source files or raw code. We believe that providing access to source files is essential for your creative freedom and future collaborations, and we stand by our commitment to inclusivity and transparency in our business practices.

Project Scope and Revisions:

We aim to provide a clear and comprehensive project scope at the beginning of our collaboration. Any changes or alterations required beyond the agreed scope or after the acceptance of the draft design will be subject to separate hourly charges, as stated in the initial proposal/quote. We encourage open communication throughout the design process to ensure that your vision is realised while adhering to project timelines and budgets.

Project Duration and Overruns:

While we provide estimated project durations, it is essential to consider them as estimations. At Tatak Studio Pty Ltd, we cannot be held responsible for any project overruns, regardless of the cause. The estimated project duration starts from the date we receive cleared funds for the initial payment or the date confirmed in writing by Tatak Studio Pty Ltd.

Rights of Refusal:

Our commitment to creating responsible and meaningful designs means that we will not include any text, images, or data in our designs that we deem to be immoral, offensive, obscene, or illegal. We uphold a high standard of ethical practices and will work collaboratively to ensure that your designs reflect your values and brand identity positively.
